About Our Terms Of Service

Please note that by submitting your deposit for our services you are agreeing to all of our terms of service as displayed here.

Web Design Quotes & Deposits

Quotes provided will be honoured for 30 days. A new quote will then be provided upon request, Websiteking can not guarantee you will get the same deal when reapplying for a quote.

A deposit of 25% is required before any work is carried out. In the case of print works a deposit of 50% is required. In all cases, this deposit is non-refundable and covers our time in creating preview designs or otherwise working on behalf of the client.

It is the Websiteking policy that any outstanding accounts are required to be paid in full no later than 30 days from the client being informed of the end of their project. If accounts are not settled or Websiteking have not been contacted regarding the delay, access to the related website may be denied and Court action taken.

If we are unable to communicate with a client on a project for a duration of at least sixty days (60) by phone or email during the design and development process, the project will be canceled without further notice and no refund will be issued. Websiteking reserve the right to delete any files created to that point.

Compatibility

Websiteking will endeavor to ensure that any designed site or application will function correctly on the server it is initially installed in and that it will function correctly when viewed with the web browsing software Microsoft Internet Explorer 7 and to an acceptable level with Mozilla Firefox. Websiteking offer no guarantees of correct function with other browser software.

Whilst every endeavor will be made to ensure that the website and any scripts or programs are free of errors, Websiteking cannot accept responsibility for any losses incurred due to malfunction of the website or any part of it.

Web Hosting and Domain Names

Websiteking will not be liable for any costs incurred, compensation or loss of earnings due to the unavailability of the site or any material provided by its agents. Where the hosting / domain name are not provided by Websiteking, it is the clients responsibility to set up these services and report any problems to the original company of purchase. A charge will be made should you require Websiteking to do this on your behalf.

Copyright

Upon completion of the project, Websiteking transfers all rights and ownership of custom designs and programming written by Websiteking to the client. Software and third party graphics or programs are not transferred to the client and remain under copyright of their respective owners.

Websiteking reserves the right to resell custom designed web sites that remain unpaid by the original client, unaccepted mockups or other graphics created by Websiteking but not in legal use by the client.

Websiteking accept no responsibility for the copyright of text, images and code sent to us by client - it is the client's responsibility to ensure they are legally allowed to use/display any item sent to us.

Websiteking will place a link on your website in the footer area back to www.websiteking.co.uk. Other arrangements can be made if the client wishes to have it removed.

Liability

Services are provided 'as is' without warranty of any kind that the item will be uninterrupted or error free. In no event shall Websiteking be liable to the client for any direct, indirect, special, punitive, incidental, or consequential damages arising out of the use, misuse or inability to use the website, services, and/or goods provided to the client. This includes, without limitation, lost profits, business interruption, loss of data or other losses directly resulting from the use of the website, services, and/or goods provided to the client. The entire risk as to the quality and performance of the web design is with the client.

Regarding Our Freebies

The copyright of the software and ebooks within our 'freebies' section is detailed within the license text document in the said download.

Ownership and copyright of website templates created by Websiteking remain with Websiteking and are not transferred to the client.

The copyright of the articles displayed within our freebies section remain the copyright of Websiteking, whilst webmasters are free to link to their relative pages they may not copy or claim ownership to them in any way.

Changes In Our Terms

Websiteking reserves the right to change or update these terms at any time without prior notice.
